1. Üldsätted
1.1. Käesolev privaatsuspoliitika reguleerib isikuandmete kogumist, töötlemist ja säilitamist käsitlevaid põhimõtteid. Isikuandmeid kogub töötleb ja säilitab isikuandmete vastutav töötleja SA Eesti Filharmoonia Kammerkoor (edaspidi andmetöötleja).
1.2. Andmesubjekt privaatsuspoliitika tähenduses on klient või muu füüsiline isik, kelle isikuandmeid andmetöötleja töötleb.
1.3. Klient privaatsuspoliitika tähenduses on igaüks, kes teostab andmetöötleja kodulehel toetuse tegemist.
1.4. Andmetöötleja järgib õigusaktides sätestatud andmete töötlemise põhimõtteid, muuhulgas töötleb andmetöötleja isikuandmeid seaduslikult, õiglaselt ja turvaliselt. Andmetöötleja on võimeline kinnitama, et isikuandmeid on töödeldud vastavalt õigusaktides sätestatule.
2. Isikuandmete kogumine, töötlemine ja säilitamine
2.1. Isikuandmed, mida andmetöötleja kogub, töötleb ja säilitab, on kogutud SA Eesti Filharmoonia Kammerkoori kodulehel oleva elektroonilise annetusvormi vahendusel.
2.2. Oma isikuandmete jagamisega annab andmesubjekt andmetöötlejale õiguse koguda, korraldada, kasutada ja hallata privaatsuspoliitikas määratletud eesmärgil isikuandmeid, mida andmesubjekt www.epcc.ee kodulehel toetusmakset tehes andmetöötlejale jagab.
2.3. Andmesubjekt vastutab selle eest, et tema poolt esitatud andmed oleksid täpsed, õiged ja terviklikud. Teadlikult valeandmete esitamist peetakse privaatsuspoliitika rikkumiseks. Andmesubjekt on kohustatud andmetöötlejat viivitamatult teavitama esitatud andmete muutumisest.
2.4. Andmetöötleja ei vastuta andmesubjekti poolt valeandmete esitamisest põhjustatud kahju eest andmesubjektile või kolmandatele osapooltele.
3. Klientide isikuandmete töötlemine
3.1. Andmetöötleja võib töödelda järgnevaid andmesubjekti isikuandmeid:
3.1.1. Ees- ja perekonnanimi;
3.1.2. Isikukood;
3.1.3. E-posti aadress;
3.1.4. Arvelduskonto number;
3.2. Lisaks eeltoodule on andmetöötlejal õigus koguda kliendi kohta andmeid, mis on kättesaadavad avalikes registrites.
3.3. Isikuandmete töötlemise õiguslik alus on isikuandmete kaitse üldmääruse paragrahv 6 lg 1 p-d a), b), c) ja f):
a) andmesubjekt on andnud nõusoleku töödelda oma isikuandmeid ühel või mitmel konkreetsel eesmärgil;
b) isikuandmete töötlemine on vajalik andmesubjekti osalusel sõlmitud lepingu täitmiseks või lepingu sõlmimisele eelnevate meetmete võtmiseks vastavalt andmesubjekti taotlusele;
c) isikuandmete töötlemine on vajalik vastutava töötleja juriidilise kohustuse täitmiseks;
f) isikuandmete töötlemine on vajalik vastutava töötleja või kolmanda isiku õigustatud huvi korral, välja arvatud juhul, kui sellise huvi kaaluvad üles andmesubjekti huvid või põhiõigused ja -vabadused, mille nimel tuleb kaitsta isikuandmeid, eriti juhul kui andmesubjekt on laps.
3.4. Isikuandmete töötlemine vastavalt töötlemise eesmärgile:
3.4.1. Töötlemise eesmärk - tellimuse ehk toetuse töötlemine
Isikuandmete säilitamise maksimaalne aeg - vastavalt seaduses nimetatud tähtaegadele
3.4.2. Töötlemise eesmärk - finantstegevus, raamatupidamine

3.5. Andmetöötlejal on õigus klientide isikuandmeid jagada kolmandate isikutega, kelleks on näiteks volitatud andmetöötlejad, raamatupidajad, ülekandeteenuseid pakkuvad ettevõtted. Andmetöötleja on isikuandmete vastutav töötleja. Andmetöötleja edastab maksete teostamiseks vajalikud isikuandmed volitatud töötleja Maksekeskus AS-ile.
3.6. Andmesubjekti isikuandmete töötlemisel ja säilitamisel rakendab andmetöötleja organisatoorseid ja tehnilisi meetmeid, mis tagavad isikuandmete kaitse juhusliku või ebaseadusliku hävitamise, muutmise, avalikustamise ja mis tahes muu ebaseadusliku töötlemise eest.
3.7. Andmetöötleja säilitab andmesubjektide andmeid eesmärgipäraselt ja minimaalselt.
4.1. Andmesubjektil on õigus saada ligipääs oma isikuandmetele ning nendega tutvuda.
4.2. Andmesubjektil on õigus saada informatsiooni tema isikuandmete töötlemise kohta.
4.3. Andmesubjektil on õigus täiendada või parandada ebatäpseid andmeid.
4.4. Kui andmetöötleja töötleb andmesubjekti isikuandmeid andmesubjekti nõusoleku alusel, siis on andmesubjektil õigus igal ajal nõusolek tagasi võtta.
4.5. Andmesubjekt saab õiguste teostamiseks pöörduda SA EFK poole aadressil epcc@epcc.ee
4.6. Andmesubjektil on oma õiguste kaitseks võimalik esitada kaebus Andmekaitse Inspektsioonile juhul, kui andmesubjekt on eelnevalt teinud pöördumise SA EFK poole ning vaidlus andmetöötleja SA EFK ja andmesubjekti vahel on jäänud lahenduseta.
5.1. Käesolevad andmekaitsetingimused on koostatud kooskõlas Euroopa Parlamendi ja nõukogu määrusega (EL) nr 2016/679 füüsiliste isikute kaitse kohta isikuandmete töötlemisel ja selliste andmete vaba liikumise ning direktiivi 95/46 / EÜ kehtetuks tunnistamise kohta / EÜ (isikuandmete kaitse üldmäärus), Eesti Vabariigi isikuandmete kaitse seadusega ning Eesti Vabariigi ja Euroopa Liidu õigusaktidega.
5.2. Andmetöötlejal on õigus andmekaitsetingimusi osaliselt või täielikult muuta, teavitades andmesubjekte muudatustest kodulehe www.epcc.ee kaudu.
EPCC.TV is a professional online video platform of Estonian Philharmonic Chamber Choir that allows consumers like you to view video programs of EPCC. You can watch the program of EPCC.TV either for free or by purchasing a ticket (henceforth: Service) via EPCC.TV website. The video streaming service on EPCC.TV is offered by Voogle OÜ (www.voogle.ee). The Estonian Philharmonic Chamber Choir (EPCC) is a mission-based cultural organization, whose main activity is the performing and recording of Estonian culture and music. The areas of the EPCC's activity include concerts, recording and diversifying music education. The earnings of ticket purchase via EPCC.TV website and all donations made to EPCC are being used only for the purposes of EPCC's mission and activities regarding the Service of EPCC.TV (including copyright use, program licenses, intellectual property rights etc.).
Terms of Use
These Terms of Use (with all the documents named in it) are the entire Agreement between you and EPCC relating to your right to use the Service of EPCC.TV and your right to access the www.epcc.ee in terms of making a donation. By using the service of EPCC.TV and making a donation payment to EPCC through www.epcc.ee website, you affirm to enter into this Agreement and confirm that you have read these Terms of Use and accepted them. If you do not agree with the terms of this Agreement, please do not use the site and the Service of EPCC.TV.
How to purchase ticket via EPCC.TV?
If you would like to view video programs of EPCC, please select video you would like to start watching from the playlist on EPCC.TV and open the description of the video and click on the button “Buy ticket”. You will be displayed the options of ticket purchase. To purchase tickets, the buyer should select the class of ticket and amounts, and enter the required information, which may vary across events. Ticket purchase methods via EPCC.TV are provided by:
- Fienta
- Zlick (Mobile payments)
Payment methods of ticket purchase via EPCC.TV:
- Bank links in Estonia, Latvia and Lithuania: Swedbank, SEB, Luminor, LHV, Coop Bank
- Visa / MasterCard, Maestro and American Express credit card payments*
- Klarna/Sofort in Austria, Belgium, Spain, the Netherlands, Italy and Germany.
- iDEAL in the Netherlands.
- Transfer based on an invoice in Estonia and EU.
- Mobile payments
*Credit card payments from some countries may be blocked due to the financial sanctions of EU.
Please note that your ticket purchase will be made outside EPCC.TV securely via the following payment methods provided by Zlick (if using the mobile payment) and in other cases by Fienta. The EPCC has no access to the bank or credit card information of the consumer. Buyer will receive the purchased e-tickets via e-mail or mobile phone immediately after making the payment in their internet bank, by credit card, as a transfer based on an invoice or by mobile payment.
The currency of ticket purchase is Euro (€).
Intellectual Property Rights
The Content of EPCC.TV is protected by Estonian and international copyright, trademark and other laws. All the copyrights and intellectual property rights related to the Service of EPCC.TV (including all the text, graphics, edited content, all information, all layouts, all drawings, images, HTML, appearance and feel, photos, music, sounds, images, software, videos, design, font and other content, that the users see or read when using the platform) are the property of EPCC and are licensed only for distribution on EPCC.TV. We will give the user an access to the program of EPCC.TV, but it does not give you the right to the material nor to the distribution of the material. You have the right to use EPCC.TV only if you accept the conditions below:
- You may not copy, adapt, modify, publish, reproduce, rent, redesign, loan, create derivative works of, sell, upload, post, transmit and distribute the materials from the EPCC.TV or make it publicly available in any other way (nor authorize any other person to do so) except by methods expressly permitted on the site and herein. Using material protected by rights (except if authorized in the terms of Service) without EPCC's prior written expressed consent and/or (if applicable) without the authorization of the owner of the content created by the user is prohibited.
- You may not download the content from EPCC.TV by any other methods permitted in the terms of use of EPCC.TV. You may not transmit or share the Service and content of EPCC.TV and may not use them on commercial use.
- You may not remove, change, reproduce or otherwise exploit the Service structure or security of the EPCC.TV. You may not harm the technology or software that is part of the Service.
By purchasing the ticket you will not obtain any rights for the material protected by rights nor get the right to distribute any part of the material. If offered by the EPCC.TV, you may download the Program only for non-commercial use. In case the EPCC.TV offers downloads, please note that it is still the property of EPCC and even if the distribution is allowed on limited conditions, we kindly ask you to respect the trademark of producers and the EPCC by indicating to them while using the materials.
In case of violations of these terms and conditions of intellectual property rights, EPCC has the right to limit or immediately terminate your access to the Service of EPCC.TV as well as suspend or remove your account. If you breach this Agreement or violate any law or third-party right we have the right to ask for indemnification from you.
How to make a donation via EPCC.TV?
The EPCC believes music belongs to everyone and for that reason most of the Service provided on EPCC.TV is free of charge. Therefore we are very grateful for the support and trust of our audiences. If you would like to make a donation to EPCC via EPCC.TV, please select the option “Donate” from the main menu of www.epcc.tv. You will be displayed the payment form on the screen. Please fill in all of the required fields of the payment form, insert the desired amount and choose the most suitable payment method provided by Maksekeskus AS.
You can support EPCC's activities either by making a single or a continuous donation. Please note that the EPCC has no access to the bank or credit card information of the donor. Your donation to EPCC will be paid outside EPCC.TV website securely via the following payment methods provided by Maksekeskus AS.

Conditions of tax return
The EPCC is foundation that operates in the public interest of Estonian Republic and has entered in the list of associations benefiting from income tax incentives giving our donors an opportunity to receive income tax incentives from donations and gifts. Donations to the EPCC by tax residents of Estonia are tax-deductible, meaning that citizens of Estonia can get a tax refund on their donation.
If you would like to get tax refund please choose the option of „I would like to apply for tax refund” on the application form while making your donation to EPCC and fill in your first name and your personal identification code. The EPCC has the obligation to transfer the personal data of donors and their donation information to the Estonian Tax and Customs Board in order to apply tax return. The amount of the donation will be automatically taken into account on your pre-filled income tax return form.
The deductions for the citizens of Estonia are in total limited to 1,200 euros per taxpayer during a period of taxation.
For resident legal persons (organization), the income tax is not charged on donations made during a calendar year in an amount not exceeding one of the following limit values:
1) 3 per cent of the amount of the payments subject to social tax.
2) 10 per cent of the profits for the last financial year.
NB! Tax deductions described in these Terms of Use apply only for the tax residents and citizens of Estonian Republic. For more detailed information about tax refund, please consult your own tax advisor.
Privacy and processing of personal data
Personal data of the users of EPCC.TV and donors is processed and stored by Estonian Philharmonic Chamber Choir, who is the controller of the personal data. The EPCC observes the principles relating to personal data processing provided by legislation and, among other things, processes personal data in a lawful, fair, and secure manner. The controller is able to declare that personal data has been processed in accordance with the provisions of the legislation. The EPCC uses the personal data entered by the donor only for processing the ticket purchase, donation and tax deductions. The personal data necessary for the execution of payments is transferred to authorized processors Maksekeskus AS, Fienta, Zlick and to the Estonian Tax and Customs Board in order to apply for the tax deduction.
The EPCC stores your personal information on your permission and sends you newsletters only if you have expressed your wish to receive them by entering your e-mail address on the website and indicating your desire to receive direct mail.
The donor is able to opt-out of EPCC's newsletters sent to their e-mail address at any time by letting us know via e-mail epcc@epcc.ee or by following the instructions in a newsletter.
